Treatment of sick children of Jehovah's Witness and Christian Scientist families at times presents significant dilemmas to American medicine and ethics, for modern healthcare professionals rely heavily on active treatment, and withholding of some treatments is a central religious tenet for Witnesses and Scientists. In important instances, physicians, nurses, ethicists, and courts may wish to set aside traditional religious beliefs and values when medical values support treatment to which adherents of these sects at times object.

Health research increasingly relies on organized collections of health data and biological samples. There are many types of sample and data collections that are used for health research, though these are collected for many purposes, not all of which are health-related. These collections exist under different jurisdictional and regulatory arrangements and include: 1) Population biobanks, cohort studies, and genome databases 2) Clinical and public health data 3) Direct-to-consumer genetic testing 4) Social media 5) Fitness trackers, health apps, and biometric data (...) sensors Population biobanks, cohort studies, and genome databases Clinical and public health data Direct-to-consumer genetic testing Social media Fitness trackers, health apps, and biometric data sensors Ethical, legal, and social challenges of such collections are well recognized, but there has been limited attention to the broader societal implications of the existence of these collections. Although health research conducted using these collections is broadly recognized as beneficent, secondary uses of these data and samples may be controversial. We examine both documented and hypothetical scenarios of secondary uses of health data and samples. In particular, we focus on the use of health data for purposes of: Forensic investigations Civil lawsuits Identification of victims of mass casualty events Denial of entry for border security and immigration Making health resource rationing decisions Facilitating human rights abuses in autocratic regimes Forensic investigations Civil lawsuits Identification of victims of mass casualty events Denial of entry for border security and immigration Making health resource rationing decisions Facilitating human rights abuses in autocratic regimes Current safeguards relating to the use of health data and samples include research ethics oversight and privacy laws. These safeguards have a strong focus on informed consent and anonymization, which are aimed at the protection of the individual research subject. They are not intended to address broader societal implications of health data and sample collections. As such, existing arrangements are insufficient to protect against subversion of health databases for non-sanctioned secondary uses, or to provide guidance for reasonable but controversial secondary uses. We are concerned that existing debate in the scholarly literature and beyond has not sufficiently recognized the secondary data uses we outline in this paper. Our main purpose, therefore, is to raise awareness of the potential for unforeseen and unintended consequences, in particular negative consequences, of the increased availability and development of health data collections for research, by providing a comprehensive review of documented and hypothetical non-health research uses of such data. The papers published here were given at the second biennial conference of the Hegel Society of America, held at the University of Notre Dame, November 9-11, 1972. They appear in an order which reflects roughly two headings: (1) Hegel's conception of the history of philosophy in general, and (2) his relation to individual thinkers both before and after him. Given the importance of the history of philosophy for Hegel, and the far-reaching impact of his thought upon subsequent philosophy, it becomes (...) immediately apparent that we have here only a beginning. At the conference, cries went up "Why not Hegel and Aristotle, Aquinas, HusserI and Hart mann?" Indeed, why not? The answer, of course, might be given by Hegel himself : if we wish to accomplish anything, we have to limit ourselves. We trust that future conferences and scholarship will bring to light these relationships and the many more which testify to Hegel's profound presence in the mainstream of past and present thought. It is furthermore no accident that the renaissance of Hegelian studies has brought with it a rebirth of the history of philosophy as something relevant to our own problems. For Hegel, the object of philosophy is alone the truth, the history of philosophy is philosophy itself, and this truth which it gives us cannot be what has passed away. (shrink)

This article is an attempt to situate imagination within consciousness complete with its own pre-cognitive, cognitive, and meta-cognitive domains. In the first sections we briefly review traditional philosophical and psychological conceptions of the imagination. The majority have viewed perception and imagination as separate faculties, performing distinct functions. A return to a phenomenological account of the imagination suggests that divisions between perception and imagination are transcended by precognitive factors of sense of reality and non-reality where perception and imagination play an indivisible (...) role. In fact, both imagination and perception define sense of reality jointly according to what is possible and not possible. Absorption in a possible world depends on the strengths of alternative possibilities, and the relationship between core and marginal consciousness. The model may offer a parsimonious account of different states and levels of imaginal consciousness, and of how “believed-in imaginings” develop and become under some circumstances “lived-in experiences.”. The literature on deep brain stimulation (DBS) and adaptive DBS (aDBS) raises concerns that these technologies may affect personality, mood, and behavior. We conducted semi-structured interviews with researchers (n = 23) involved in developing next-generation DBS systems, exploring their perspectives on ethics and policy topics including whether DBS/aDBS can cause such changes. The majority of researchers reported being aware of personality, mood, or behavioral (PMB) changes in recipients of DBS/aDBS. Researchers offered varying estimates of the frequency of PMB changes. A (...) smaller majority reported changes in personality specifically. Some expressed reservations about the scientific status of the term ‘personality,’ while others used it freely. Most researchers discussed negative PMB changes, but a majority said that DBS/aDBS can also result in positive changes. Several researchers viewed positive PMB changes as part of the therapeutic goal in psychiatric applications of DBS/aDBS. Finally, several discussed potential causes of PMB changes other than the device itself. (shrink)

Drawing on a landscape analysis of existing data-sharing initiatives, in-depth interviews with expert stakeholders, and public deliberations with community advisory panels across the U.S., we describe features of the evolving medical information commons. We identify participant-centricity and trustworthiness as the most important features of an MIC and discuss the implications for those seeking to create a sustainable, useful, and widely available collection of linked resources for research and other purposes.

The expansion of research on deep brain stimulation (DBS) and adaptive DBS (aDBS) raises important neuroethics and policy questions related to data sharing. However, there has been little empirical research on the perspectives of experts developing these technologies. We conducted semi-structured, open-ended interviews with aDBS researchers regarding their data sharing practices and their perspectives on ethical and policy issues related to sharing. Researchers expressed support for and a commitment to sharing, with most saying that they were either sharing their data (...) or would share in the future and that doing so was important for advancing the field. However, those who are sharing reported a variety of sharing partners, suggesting heterogeneity in sharing practices and lack of the broad sharing that would reflect principles of open science. Researchers described several concerns and barriers related to sharing, including privacy and confidentiality, the usability of shared data by others, ownership and control of data (including potential commercialization), and limited resources for sharing. They also suggested potential solutions to these challenges, including additional safeguards to address privacy issues, standardization and transparency in analysis to address issues of data usability, professional norms and heightened cooperation to address issues of ownership and control, and streamlining of data transmission to address resource limitations. Researchers also offered a range of views on the sensitivity of neural activity data (NAD) and data related to mental health in the context of sharing. These findings are an important input to deliberations by researchers, policymakers, neuroethicists, and other stakeholders as they navigate ethics and policy questions related to aDBS research. Genomic research results and incidental findings with health implications for a research participant are of potential interest not only to the participant, but also to the participant's family. Yet investigators lack guidance on return of results to relatives, including after the participant's death. In this paper, a national working group offers consensus analysis and recommendations, including an ethical framework to guide investigators in managing this challenging issue, before and after the participant's death.

Background: Genomic analysis may reveal both primary and secondary findings with direct relevance to the health of probands’ biological relatives. Researchers question their obligations to return findings not only to participants but also to family members. Given the social value of privacy protection, should researchers offer a proband’s results to family members, including after the proband’s death? Methods: Preferences were elicited using interviews and a survey. Respondents included probands from two pancreatic cancer research resources, plus biological and nonbiological family members. (...) Hypothetical scenarios based on actual research findings from the two cancer research resources were presented; participants were asked return of results preferences and justifications. Interview transcripts were coded and analyzed; survey data were analyzed descriptively. Results: Fifty-one individuals (17 probands, 21 biological relatives, 13 spouses/partners) were interviewed. Subsequently, a mailed survey was returned by 464 probands, 1,040 biological family members, and 399 spouses/partners. This analysis highlights the interviews, augmented by survey findings. Probands and family members attribute great predictive power and lifesaving potential to genomic information. A majority hold that a proband’s genomic results relevant to family members’ health ought to be offered. While informants endorse each individual’s choice whether to learn results, most express a strong moral responsibility to know and to share, particularly with the younger generation. Most have few concerns about sharing genetic information within the family; rather, their concerns focus on the health consequences of not sharing. Conclusions: Although additional studies in diverse populations are needed, policies governing return of genomic results should consider how families understand genomic data, how they value confidentiality within the family, and whether they endorse an ethics of sharing. A focus on respect for individual privacy—without attention to how the broad social and cultural context shapes preferences within families—cannot be the sole foundation of policy. (shrink)

Through the use of Bayesian probability theory and Communication theory, a formal mathematical model of a Churchmanian Dialectical Inquirer is developed. The Dialectical Inquirer is based on Professor C. West Churchman's novel interpretation and application of Hegelian dialectics to decision theory. The result is not only the empirical application of dialectical inquiry but also its empirical (i.e., scientific) investigation. The Dialectical Inquirer is seen as especially suited to problems in strategic policy formation and in decision theory. We present an algorithm to infer causal relations between a set of measured variables on the basis of experiments on these variables. The algorithm assumes that the causal relations are linear, but is otherwise completely general: It provides consistent estimates when the true causal structure contains feedback loops and latent variables, while the experiments can involve surgical or `soft' interventions on one or multiple variables at a time. The algorithm is `online' in the sense that it combines the results from (...) any set of available experiments, can incorporate background knowledge and resolves conflicts that arise from combining results from different experiments. In addition we provide a necessary and sufficient condition that determines when the algorithm can uniquely return the true graph, and can be used to select the next best experiment until this condition is satisfied. Returning genomic research results to family members raises complex questions. Genomic research on life-limiting conditions such as cancer, and research involving storage and reanalysis of data and specimens long into the future, makes these questions pressing. This author group, funded by an NIH grant, published consensus recommendations presenting a framework. This follow-up paper offers concrete guidance and tools for implementation. The group collected and analyzed relevant documents and guidance, including tools from the Clinical Sequencing Exploratory Research Consortium. The authors then (...) negotiated a consensus toolkit of processes and documents. That toolkit offers sample consent and notification documents plus decision flow-charts to address return of results to family of living and deceased participants, in adult and pediatric research. Electrical resistivity and ac-calorimetric measurements reveal a complex magnetic phase diagram for single crystals of the ferromagnetic Kondo-lattice compound CeAgSb2 at high pressures up to 80 kbar. The ferromagnetic order at TC = 9.6 K at ambient pressure is completely suppressed at a critical pressure PC = 35 kbar. Another magnetic transition, possibly antiferromagnetic, found above 27 kbar, attains a maximum value TN 6 K at 44 kbar and then appears to be completely suppressed by 50 kbar. Thermodynamic and transport (...) measurements in the ferromagnetic state indicate an energy gap Δ 30 K in the spin-wave excitation spectrum at ambient pressure which decreases to Δ 10 K at P = 30 kbar. No superconductivity is observed at ambient pressure above T 0.1 K, under applied pressure in the ferromagnetic state (P = 28.5 kbar), nor in the antiferromagnetic state (P = 33 − 46 kbar) above 0.3 K. © 2003 The American Physical Society. I find in Kant two distinct conceptions of the priority of practical over theoretical reason, focused on belief and on action. The former actually involves a higher priority of theoretical reason. The latter, in contrast, gives genuine priority to practical reason by noting that theoretical considerations are irrelevant in moral decision-making. I argue that the former conception requires one to abandon genuine priority of the practical, while the latter conception requires one to abandon the necessary unity of reason. O postulado prático da existência de Deus é problemático por várias razões: primeiro, Kant nega que ele proporciona qualquer cognição da natureza ou existência de Deus como um ser em si; segundo, ele salienta a natureza prática do postulado contribuindo para o desempenho de nossos deveres; e, terceiro, Kant parece mesmo algumas vezes indicar que nosso postulado de Deus não corresponde a nenhuma realidade, mas é um mero pensamento. No meu trabalho, eu sustento o argumento que o postulado de Kant (...) de Deus pode ser melhor entendido como um conceito sem extensão que serve para unificar vários outros conceitos e obrigações morais mas que ele próprio não tem referência. Eu sustento esse argumento apontando para a relação do postulado para o propósito da filosofia prática, em oposição à teórica e pelo exame da função regulativa da razão em geral e invocando a teologia construtivista contemporânea. A fim de mostrar este ponto eu primeiro analiso a natureza de um postulado comparando postulados a hipóteses transcendentais e crenças da Crítica da Razão Pura. Em segundo lugar, eu examino o uso que Kant faz do postulado da existência de Deus como sendo “imanente... para propósitos práticos” e “somente em referência à lei moral e em função dela” na Crítica da Razão Prática. Terceiro, eu procuro pela função que o postulado de Deus desempenha no Opus Postumum e em outros textos de 1790 para mostrar que Kant chegou mais e mais a argumentar pelo papel funcional ao invés do referencial desse postulado. Ao longo do trabalho, eu discuto a natureza da filosofia prática – direcionada ao uso livre das nossas vontades – como sendo distinta da filosofia teórica – dirigida ao conhecimento dos objetos. Eu mostro como essa solução pode fazer Kant um naturalista metafísico. Eu também entro em questões contemporâneas da teologia relacionadas com o papel humano na construção de sistemas conceituais para ajudá-los a fazer sentido ao mundo que eles experienciam no contexto de um mistério maior que desafia a conceitualização.Kant’s practical postulate for the existence of God is puzzling for several reasons: first, he denies that it provides any cognition of the existence or nature of God as a being in itself, second, Kant stresses the practical nature of the postulate as contributing to performance of our duties, and third, Kant even seems on occasion to indicate that our postulate of God does not correspond to any reality but is a merely a thought. In my paper I advance the argument that Kant’s postulate of God is best understood as an extensionless concept that serves to unify various other moral concepts and moral obligations but that has no referent itself. I make this argument by noting the relation of the postulate to the purpose of practical, as opposed to theoretical, philosophy, and by examination of the regulative role of reason in general, and by invoking contemporary constructivist theology. In order to show this point I first examine the nature of a postulate by comparing postulates to transcendental hypotheses and to beliefs from the Critique of Pure Reason. I second examine the use to which Kant puts the postulate of the existence of God as “immanent . . . for practical purposes” and “only in reference to the moral law and for the sake of it” in the Critique of Practical Reason. Third, I look at the role that the postulate of God plays in Kant’s Opus Postumum and other texts from the 1790s to show that Kant came more and more to argue that the postulates have this functional rather than referential role. Throughout the paper I discuss the nature of practical philosophy – directed toward the free use of our wills – as distingushed from theoretical philosophy – directed toward knowledge of objects. I note how this solution could make Kant a metaphysical naturalist. I also touch on contemporary issues in theology related to the role of human construction of systems of concepts to help them make sense of the world they experience in the context of a greater mystery that defies conceptualization. This study was concerned with Wason's THOG task, a hypothetico-deductive reasoning problem for which performance is typically very poor ( < 20% correct). Recently, however, Needham and Amado (1995) and Koenig and Griggs (2004) have observed both facilitation and spontaneous analogical transfer effects for the Pythagoras version of this task. Based on their findings, Koenig and Griggs concluded that in addition to the separation of the data (the properties of the designated THOG) from the hypotheses that need to (...) be generated (the possible combinations of properties written down), an explicit request to generate these hypotheses is necessary to obtain significant analogical transfer. In the present study we extended the generalisability of this conclusion in three experiments with 214 undergraduate participants using O'Brien et al.'s (1990) Blackboard version of the task. We discuss the relationship of the results to dual process theories of reasoning and propose that analogical transfer may be a better criterion than task facilitation for judging participants' task understanding. Consider predicates like 'is a fictional character' and 'is a mythical object'. Since their ascription entails a corresponding Negative Existential claim, call these 'NE-characterizing predicates'. Objectualists such as Parsons, Sylvan, van Inwagen, and Zalta think that NE-characterizing properties are genuine properties of genuinely non-existent objects. But how, then, to make room for statements like 'Vulcan is a failed posit' and 'that little green man is a trick of the light'? The predicates involved seem equally NE-characterizing yet on the surface fail (...) to mark a genuine property o f things. Instead, the truth of such predications strongly supervenes on types of referential failure. Kendall Walton's anti-objectualist account of talk about fiction provides a neat solution to this supervenience problem by invoking special games of make-believe. The present paper claims that while Walton's view thereby gains an important advantage over objectualism, the solution faces problems of its own. The rest of the paper desribes another solution, one that assigns a large role to the idea of metaphor. (shrink)

What capitalist economics call business or trade cycles with their recessions and depressions, and Marxists, in terms of surplus value and exploitation, call crises are fundamental misunderstandings of what Bernard Lonergan conceives as the true intelligibility of the rhythms of production and monetary circulation of the advanced exchange economy. In his circulation analysis he expresses the intelligibility of macroeconomic dynamics in terms of a pure cycle that involves the anti-egalitarian flows proper to new surplus or productive goods expansion and the (...) egalitarian flows proper to basic or consumer goods expansion, which Marxists correctly complain are not fully carried out. Crucial to the smooth expansion are (1) the crossover payments between surplus and basic monetary circuits in harmony with the phases of economic development, (2) the re-understanding of profit not as a criterion of economic activity but as involving a group interest that does not strictly 'belong' to capitalist entrepreneurs, and yet cannot be negotiated by a socialist bureaucracy. The issue is not greed on the part of either capitalists or workers but ignorance, which this analysis tries to correct. /// O presente artigo mostra de que modo aquilo que na economia capitalista é considerado como um ciclo de negócio ou de comércio com as suas respectivas reces-sões e depressões, e os Marxistas, interpretando o fenómeno em termos de mais-valia e de exploração, chamam de crises, é concebido por Bernard Lonergan nos termos de uma verdadeira inteligibilidade dos ritmos de produção e da circulação monetária próprios à economia de mercado avançada. Lonergan exprime na sua análise da circulação económica a inteligibilidade da dinâmica macroeconómica em termos de um puro ciclo que envolve as cadências anti-igualitárias próprias a novos excedentes comerciais ou expansão dos bens produtivos e as cadências igualitárias próprias à expansão dos bens básicos ou de consumo, o qual os Marxistas, com justiça, consideram que no capitalismo não são completamente cumpridas. Lonergan mostra, assim, que crucial para uma expansão equilibrada é necessário (1) o cruzamento de pagamentos entre excedentes e circuitos monetários básicos em harmonia com as fases do desenvolvimento económico, (2) uma nova compreensão do lucro não como critério da actividade económica, mas como envolvente do interesse grupal que não pertence estritamente a empresários capitalistas, e contudo não pode ser negociada por uma burocracia socialista. Deste modo, mostra-se que o problema fundamental da economia não é o egoísmo da parte dos capitalistas ou dos trabalhadores, mas sim a ignorância, problema este que Lonergan, mediante a sua análise, tenta corrigir. Hans-Georg Gadamer's hermeneutic philosophy is most well known for its phenomenology of interpretation in the Geisteswissenschaften or humanities. It moves Heidegger's ' As–structure ' of understanding through an appreciation of the primacy of questioning to the dialogical structure of interpretation as mediated by language. This phenomenology grounds a linguistic ontology, which rehabilitates metaphysics as a renewal of the tradition of a metaphysics of light, without transgressing the limits of phenomenological accessibility. The result is a metaphysics of finitude that is undogmatically (...) open to the infinite. At the heart of this linguistic ontology is the speculative structure by which language-in-use is related to being in a way that overcomes all kinds of representationalism and of naive picture-thinking (including empiricism and idealism). Hans-Georg Gadamer's ontology is postmodern yet genuinely metaphysical. /// A filosofia hermenêutica de Hans-Georg Gadamer é particularmente conhecida pela sua fenomenologia da interpretação no âmbito das Ciências do Espírito (Geisteswissenschaften). Esta fenomenologia fundamenta uma ontologia linguística, a qual constitui uma rehabilitação da metafisica sob a forma de uma reactualização da tradição que é a metafisica da luz, mas sem contudo transgredir os limites impostos pela acessibilidade fenomenológica da questão. Daí resulta uma metafisica da finitude aberta ao infinito de forma não dogmática. No centro desta ontologia linguística está uma estrutura especulativa segundo a qual a linguagem-uso se relaciona com o ser de forma a que todo e qualquer tipo de representacionalismo ou pensamento-imagem (onde se incluem tanto o empirismo como o idealismo) seja superado. O artigo visa, pois, demonstrar até que ponto a ontologia de Hans-Georg Gadamer é simultaneamente pós-moderna e genuinamente metafisica. (shrink)
